In consideration of being allowed to participate in the 2025 Annual Charro Trail Ride and Trail’s End Party with the Scottsdale Charros, the undersigned acknowledges, appreciates, and agrees that:
1.- The risk of injury from the activities involved in the 2025 Charro Trail Ride is significant, including the potential for permanent paralysis and death, and while particular rules, equipment and personal discipline may reduce the risk, the risk of serious injury does exist; and,
2.- I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and I assume full responsibility for my participation; and,
3.- I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will bring such to attention of the nearest Scottsdale Charro immediately; and,
4.- I understand the activities engaged in on a Charro Trail Ride. I understand the risks involved and that risks and dangers may arise due to, but are not limited to, unexpected weather, the terrain and wildlife encountered, the horse I may be riding, or the physical condition that I assume at the time of the Charro Trail Ride; and,
5.- I FULLY UNDERSTAND THAT ALCOHOLIC BEVERAGES ARE AVAILABLE DURING THE CHARRO TRAIL RIDE. I FULLY AND COMPLETELY UNDERSTAND THAT I MAY BE AT GREATER RISK IF I CONSUME ALCOHOLIC BEVERAGES DURING THE CHARRO TRAIL RIDE. I FULLY AND COMPLETELY UNDERSTAND THAT IF I CONSUME ALCOHOLIC BEVERAGES AND OPERATE A HORSE OR A MOTOR VEHICLE, I SEVERELY INCREASE THE RISK OF INJURY TO MYSELF, OTHER INDIVIDUALS AND THE HORSES PARTICIPATING IN THE CHARRO TRAIL RIDE.
6.- I am aware of the inherent risks associated with equine activities, am willing and able to accept full responsibility for my own safety and welfare and hereby release the Scottsdale Charros and the owners and lessors of any horse I use from liability unless said parties are grossly negligent or commit acts or omissions which are willful, wanton, or intentional. I acknowledge that, in this instance, the Scottsdale Charros are an agent of the owners and/or lessors of the horses used on the Charro Trail Ride. I am also aware that the Scottsdale Charros will provide transportation services to and from the CHARRO TRAIL RIDE location. If I choose or otherwise refuse to use these transportation services, I assume all risks associated with the operation of, or as a passenger in a motor vehicle not being operated as part of the transportation services. All transportation services provided by the Scottsdale Charros will be operated by a commercial motor carrier of passengers.
7.- I, for myself and on behalf of my spouse, heirs, assigns, personal representatives and next of kin, HEREBY WAIVE, RELEASE The Scottsdale Charros, The Charro Foundation, their affiliates, directors, officers, invitees, officials, agents, employees, sponsoring agencies, sponsors, advertisers, and all participants, vendors, property owners and lessors of the real property, and other third parties rendering service, participating, or otherwise directly or indirectly involved with the operation or conduct of the 2025 Charro Trail Ride (“Releasees”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or cost, claim, lawsuit, expense, loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.
8.- I agree to INDEMNIFY AND HOLD HARMLESS the Releases from any cost, claim, lawsuit, expense, loss or damage to any person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by aw.This indemnification shall include all costs and attorney’s fees.
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT INDUCEMENT.
